Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Moxy app and related services (the "Service"), operated by Darkma LLC ("Darkma", "we", "us", or "our"). By downloading, accessing, or using Moxy, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Moxy. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

2. The Service

Moxy is a skin and nutrition app. You scan your face and log your food, and Moxy scores that food for skin and overall wellness. Moxy is not a calorie tracker, weight-loss program, or medical device.

3. Not Medical Advice

The content, scores, and insights in Moxy are for general informational and educational purposes only. They are not medical advice and are not a substitute for professional diagnosis, treatment, or guidance from a qualified healthcare provider. Always consult a physician or registered dietitian before making changes to your diet, especially if you have a medical condition, are pregnant, or take medication. Never disregard or delay seeking professional advice because of something you read in Moxy.

Nutrition estimates are approximate and may be incomplete or inaccurate. Allergen information is provided on a "may contain" basis and should never be relied upon as a guarantee that a food is safe for you. If you have a food allergy or intolerance, verify ingredients independently.

4. Your Account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from Settings > Account > Delete Account.

5. Subscriptions and Payments

Moxy offers optional paid subscriptions. Purchases are processed through Apple's In-App Purchase system and are subject to Apple's terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel a subscription in your Apple account settings. Except where required by law, payments are non-refundable; refund requests are handled by Apple.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful or harmful purpose;
  • Reverse engineer, copy, or resell the Service except as permitted by law;
  • Interfere with or disrupt the Service or attempt to access it through unauthorized means;
  • Upload content that is unlawful, infringing, misleading, or violates the rights of others.

7. User Content

You retain ownership of the content you create or submit, such as recipes and notes ("User Content"). By submitting User Content, you grant Darkma a non-exclusive, worldwide, royalty-free license to host, store, display, and use it solely to operate and improve the Service. You are responsible for your User Content and confirm you have the rights to share it.

8. Intellectual Property

The Service, including its software, design, branding, and content (excluding User Content), is owned by Darkma LLC and protected by intellectual property laws. We grant you a limited, non-transferable, revocable license to use Moxy for your personal, non-commercial use.

9. Third-Party Services

Moxy relies on third-party services, including Apple, Supabase, OpenAI, and the USDA FoodData Central API. Your use of those services may be governed by their own terms, and we are not responsible for their content or availability.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that nutrition data will be accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by law, Darkma LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or reliance on the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using Moxy and delete your account at any time.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware.
